Respecting Intellectual Property

We respect the intellectual property rights of others and expect the same in return. Under the Digital Millennium Copyright Act (DMCA), copyright owners can submit takedown notices for infringing material. As an internet service provider, we hold immunity under the DMCA’s “safe harbor” provisions.

Submitting a Takedown Notice

To report copyright infringement, please submit a notice to our DMCA Agent with the following information:

  1. Identification: A physical or electronic signature from the copyright owner or authorized representative.
  2. Copyrighted Work: Identify the specific copyrighted work you believe has been infringed.
  3. Infringing Material: Identify the allegedly infringing material on our Site and provide enough detail for us to locate it (e.g., URL).
  4. Contact Information: Include your name, address, email address, phone number (optional), and a statement indicating your good faith belief that the use is unauthorized.
  5. Statement of Accuracy: Include a statement under penalty of perjury that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.  

False Claims: Title 17 U.S.C. § 512(f) imposes penalties for knowingly submitting false information in a takedown notice.

Transparency:

We may share the identity and information in any copyright infringement claim with the alleged infringer.

Counter-Notification (Restoring Material)

If your content is removed due to a copyright infringement claim, you may submit a counter-notification to our DMCA Agent. The counter-notification must include the following:

  1. Your Signature: Your physical or electronic signature.
  2. Material Description: Describe the removed material and its original location on the Site.
  3. Good Faith Belief: State under penalty of perjury that the material was removed due to a mistake or misidentification.
  4. Contact Information: Provide your name, address, phone number, and consent to the jurisdiction of the federal district court for your district (or the service provider’s district if outside the U.S.) and to accept service of process from the original claimant.

Repeat Infringer Policy

We take copyright infringement seriously. Repeat infringers may have their accounts terminated.
